Man Who Deceived a Woman And Took Her to Isolated Place, Force Himself On Her Sentence To Prison

A judge criticized the police for taking a long time to charge a dangerous criminal with rape after he committed a second brutal s*xual assault while out on bail. The criminal, Abdul Khan, aged 27, enticed a vulnerable person he met at PRYZM nightclub on Broad Street to his car and then drove to a secluded alleyway in Ward End where he raped her in 2019.

After being arrested for that crime and released on bail, he committed another rape in 2022. This time, he deceived a woman he was supposed to take to a friend’s house and took her to the same isolated place. There, he raped her and subjected her to a 40-minute ordeal, during which he repeatedly applied pressure to her neck to prevent her from escaping.

Khan, from Raymond Street, Alum Rock, was found guilty of two counts of rape and one count of assault by penetration after a trial at Birmingham Crown Court. The judge, Heidi Kubic KC, declared him “dangerous” and sentenced him to 13 years in custody with an additional five-year license period. Judge Kubic expressed disappointment that it took the police three years to charge Khan for these crimes and emphasized that after his arrest and release, he went on to commit another rape in 2022.

According to Judge Kubik, Khan showed no remorse for his victims and instructed his defense to cross-examine them vigorously during the trial, while he himself did not provide any evidence.

The judge described the prosecution’s case as strong, as both victims provided clear accounts of non-consensual sexual activity, where it was evident that they did not consent. Khan overpowered them and continued despite their objections. Although the victims did not know each other, there were similarities in their descriptions of Khan’s behavior and attitude towards them.

Khan targeted the first victim, who appeared disoriented, at PRYZM nightclub on Broad Street. He suggested they go outside for some fresh air but instead took her to his car and drove to a secluded alleyway in Ward End, where he turned off the car lights. There, he s*xually assaulted and raped the woman, who was crying and pleading to be released. The victim was terrified that he would kill her, but she managed to grab her handbag and escape. She had no idea where she was in an unfamiliar city but ran to a stranger’s house in the early hours and desperately asked them to call 999.

Khan was arrested but later released, prompting the judge to criticize the police for the delay in charging him. After his release, Khan arranged to meet the second victim, whom he had never met in person, under the pretense of going to a friend’s apartment to relax.

However, he drove her to the same secluded spot and gave her nitrous oxide balloons and cannabis. The judge stated that it was evident that the second victim did not want to have s*x with Khan, but he ignored her objections, physically overpowered her, and pinned her down on the sofa. The victim was unable to defend herself as Khan put her in a chokehold and applied increasing pressure to her neck to prevent her from breathing and escape.

Judge Kubik noted that the first victim was significantly distressed by having to relive her ordeal in court and had given up her studies. The second victim has also struggled to move on from the attack. The judge concluded that Khan was clearly dangerous based on the repeated nature of the attacks and his use of asphyxiation.

The only mitigating factor for Khan was his relatively young age and previously clean criminal record. Positive character references were also submitted on his behalf. Khan will have to serve at least two-thirds of the 13-year sentence in custody before being considered for release. Additionally, he will be required to adhere to sex offender notification requirements for the rest of his life.
